Probate litigation is necessary when the court is required to assist in the transfer of property from the deceased person, also known as the “decedent,” to the decedent’s heirs and beneficiaries.

Sometimes, there are disputes over who should receive the decedent’s property.  These disputes can come in the form of will contests or trust challenges, which occur when wills or trusts are executed despite breaches of fiduciary duties, such as undue influence or forgery.  In other cases, it can result from an improper transfer of property from the trust or estate.
